Mediating Without Lawyers

At MediateNOW, our mediation process always begins with a willingness to resolve a family law issue outside of the courtroom.

While we regularly welcome lawyer participation in every step of the process at MediateNOW, in many cases people choose to process a family law matter, either in part or in total, in mediation without lawyers. We can assist you from the start of the process to the final documents.

When both participants have decided to take advantage of all that mediation has to offer, either or both of you can contact our office. You will be scheduled for a joint, no-cost, 30- to 60-minute introduction consultation.

If you choose to move forward with the mediation process, you and Kay Creighton will create a plan for moving forward, including expectations, the sharing of information, time lines, and goals.

In mediation both parties are assisted in identifying necessary information, evaluating their goals, and considering common and unique options to achieve a mutually satisfying solution.

You can count on Kay's more than two decades of experience in managing both simple and complicated divorces, and you can be confident in Kay's ability to assist both of you in reaching a mutually agreed resolution.

The Stages of Our Mediation Process

In our first mediation session, we outline the process and identify the expectations and goals of each client. At this session there is discussion of the status of the matter, including whether proceedings have already been filed and what the next steps are in that regard.

The stages can be scheduled in shorter sessions over the course of weeks or months, or the clients can schedule an entire day of mediation working toward a complete resolution.

The stages of our mediation process include:

  • Information Identification and Gathering - With the guidance of your mediator and the staff of MediateNOW, the clients identify assets, liabilities, and all issues for resolution. At this stage there will be an identification and exchange of information.
  • Joint discussion and problem identification – We identify the common goals of both parties, where the clients are in agreement and the important issues that need resolution.
  • Negotiations and resolutions-– Each client is given time to discuss their goals, concerns and proposals with the mediator. The mediator facilitates resolution with guidance, information and strategy discussions.
  • Reaching an agreement – Agreeement between the clients drafted and signed.
